With the Hollywood writers’ strike finally coming to an end, the music world has plenty of reasons to breathe a sigh of relief, but a major one involves artificial intelligence. Alongside disputes over pay models, healthcare benefits, and other more traditional labor concerns, the use of AI emerged as a key point of contention in screenwriters’ 148-day standoff with major studios and streaming services. And now the new agreement unveiled by the Writers Guild of America includes what appears to be a first: protections for creative workers against the looming threat that generative AI tools like ChatGPT could put them out of a job.
The guarantees won by movie and TV writers include much that their songwriter peers, who have also been mobilizing around the rise of AI, might applaud. Per the WGA’s agreement, AI can’t write or rewrite scripts, and AI-generated writing can’t be considered “source material.” Writers can choose to incorporate AI into their work, in accordance with company policies of course, but it has to be their choice—the studios can’t force them to embrace the bots. And if the studios give the writers any materials that contain AI-generated writing, it must be disclosed.
However, another AI provision in the deal seems trickier: Hollywood studios have retained the right to train AI models based on writers’ work. At the same time, the WGA “reserves the right to assert that exploitation of writers’ material to train AI is prohibited under the [agreement] or other law,” the terms of the deal state. Basically, Hollywood writers can still challenge the studios’ use of their work for AI training if the guild members decide they want to tackle the issue or if laws, such as California’s proposed AI regulatory bill, take effect that would restrict such training.
While it isn’t—yet—possible for AI to create an entire movie, AI-generated music is already here. So it’s probably understandable that songwriters and screenwriters may have slightly different AI priorities. Alongside shared issues like compensation, credit, and transparency, a group of songwriters including Jimmy Jam and Terry Lewis met recently with members of Congress and called for legislation that would require songwriters’ consent before their work could be used in AI training models. Beyond music and film, several famous authors recently sued ChatGPT maker OpenAI over unauthorized AI training, while news publishers have also been working toward getting paid for allowing the training models to rove through their archives.
